1.      Description and price of the lingerie sets

1.1.    The description and price of the lingerie set you order will be shown on your order as signed by you at the time you place your order (“Order Date”).

1.2.    The lingerie is made specifically to your order and in accordance with your measurements, as set out in the ‘Measurement Appointment’. You acknowledge that the lingerie is made to measure and unique to you. You will be required to sign the ‘Measurement Form’ confirming that the measurements taken on the ‘Measurement Appointment’ are correct.

1.3.    Maria Callisto brings to your attention the fact that all lingerie is made from a combination of different fabrics and silk. As silk is a natural fibre no guarantee can be made that minor faults will not appear on the garments although every care is taken to prevent this. Maria Callisto shall not be liable for any claim arising from any dissimilarity or disparity in shade or tone of the different fabrics.

1.4.   Maria Callisto will contact you to arrange a date for you to collect lingerie (“Collection Date”). If between the ‘Measurement Appointment’ and before the Collection Date, your measurements as set out in the “Measurement Form’ have increased the Maria Callisto will not be responsible for the cost of major alterations. It is advisable that the ‘Measurement Appointment’ is set no longer than 12 weeks before your wedding date. Minor alterations can be accommodated at an extra cost but a complete change in design choice could mean a new lingerie set is needed. Maria Callisto will not be eligible for the costs of a new lingerie set.

 

2.    Payment / Deposit

2.1 On the order date you agree to pay a deposit (“Deposit”) amounting to 60% of the total price (“Price”) of the lingerie set as set out in the order and an appointment will be arranged to take your measurements. Initial appointment, first fitting and final fitting appointments are included in the invoice price. Any additional appointments due to refitting requirements will need to be discussed as an additional charge.
2.2 The balance of the Price is due on the date you collect your lingerie set.

 

3.    Delivery

3.1 Unless otherwise agreed in writing by Maria Callisto, your lingerie set must be collected from Maria Callisto. Maria Callisto will contact you to let you know when your lingerie set is ready for collection. Ownership of the lingerie set will pass to you when delivery is made and you will as from the date of delivery become responsible for all risk of loss of or damage to the lingerie set.

 

4. Your right of cancellation 

4.1 Maria Callisto shall not process your Order for 7 working days from the Order Date. Hence you have the right to cancel the contract without loss of the Deposit by notifying Maria Callisto in writing at any time up to the end of 7 working days after you place the Order. A working day is any day other than weekends and bank or Maria Callisto the contract in accordance with this condition 4.1, Maria Callisto will refund or credit you within 30 days for any sum that has been paid by you for the lingerie set.

4.2 Should you cancel the order by notifying Maria Callisto in writing after the expiry of 7 working days from the Order Date Maria Callisto will be entitled to the deposit and the lingerie set shall remain the property of Maria Callisto. In return you shall be released from any obligation to pay the balance of the price.
4.3 To exercise your right of cancellation, you must notify Maria Callisto in writing at the address shown above, giving your Order reference number and details of the lingerie set ordered.

 

5. Liability

5.1 Maria Callisto shall not be deemed to be in breach of this contract as a result of acts beyond the reasonable control of Maria Callisto including without limitation act of God, war, riot, civil commotion or terrorist attack, malicious damage, compliance with any law or governmental order, accident, fire, flood or storm.
5.2 Maria Callisto brings to your attention the fact that the lingerie set is a particularly delicate item and extreme care should be afforded to it. Consequently, Maria Callisto shall not be liable for any damage to the lingerie set arising from fair wear and tear, wilful damage, accident, negligence by you or any third party or use otherwise than as recommended by Maria Callisto or failure to follow Maria Callisto’s instructions or any alteration or repair carried out without Maria Callisto’s approval.
5.3 Maria Callisto’s liability for all direct or indirect losses as a consequence of any breach by Maria Callisto of this contract shall be limited to the price of the lingerie set.
5.4 These Terms and Conditions of Sale do not affect your statutory rights as a consumer.

6. Data Protection

6.1 Maria Callisto will take precautions to keep the details of your order and payment secure but unless Maria Callisto is negligent Maria Callisto will not be liable for un authorised access to information supplied by you. Maria Callisto will only use the information you provide about yourself for the purpose of fulfilling your order and in accordance with Maria Callisto's Privacy Policy, available on their website www.mariacallisto.com unless you agree otherwise.

 

7. Applicable Law

7.1 These Terms of sale and the supply of the lingerie set will be subject to English Law and the English courts will have jurisdiction in respect of any dispute arising from the contract.
